1. Agreement and Scope
These Terms of Service ("Terms") are a legal agreement between you and RENOVAR CONSTRUCCIONES INGENIERIA S AS ("RENOVAR", "we", "us", or "our") for your use of Opal Orbit Slots, the iOS application, and the related website at https://opalorbitslots.com (together, the "Service"). By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy explains how information is stored locally and how we handle information we may receive. The Privacy Policy is part of these Terms by reference.
2. Simulated Entertainment Only
Opal Orbit Slots is a simulated entertainment product only. It is not a gambling service, casino, betting product, sweepstakes, lottery, financial product, or money-transfer service. You acknowledge and agree that:
- The Service does not allow real-money wagers, deposits, betting, withdrawals, cash prizes, or redemption for anything of value.
- Virtual coins, rewards, balances, rooms, or other in-app items have no real-world monetary value and are provided only for entertainment inside the app.
- Virtual items cannot be sold, exchanged, transferred, withdrawn, redeemed, or converted into money, goods, services, or any other value.
- Progress, outcomes, or success in the app do not predict or improve success in real-money gambling or any other gambling activity.
3. Eligibility and Age Requirement
You must be at least 18 years old, or the age of legal majority in your location if higher, to use the Service. By using the Service, you represent that you meet this requirement and that your use is lawful where you are located. We may restrict or terminate access if we reasonably believe a user is underage or using the Service unlawfully.
4. Local Account and Device Data
The app may allow you to create or sign in to an in-app account profile. Unless the app clearly states otherwise, this is a local account stored on your device, not a cloud account maintained by RENOVAR.
- You are responsible for maintaining access to your device and any local login credentials.
- Because the account is local by default, we generally cannot restore lost local progress, recover local passwords, or transfer local balances between devices.
- Deleting the local account, clearing app data where supported, or uninstalling the app may permanently remove local progress, virtual coins, settings, and rewards from that device.
- If device backups are enabled, local app data may remain in backups controlled by you or your platform provider until those backups are deleted or overwritten.
- You may not create accounts using false information, impersonate another person, attempt to access another user's local account, or bypass app controls.
5. Account Deletion
Where the Service offers account creation, you can initiate account deletion from within the app's account or settings controls. For a local-only account, deletion removes the local account profile and associated local progress from that device. You may also uninstall the app to remove local app data from the device, subject to your platform backup settings.
If you contacted support or believe we hold information about you outside your device, you may email [email protected]. Requests involving personal information are handled under our Privacy Policy.
6. Limited License and Intellectual Property
Subject to these Terms, RENOVAR grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app for personal, non-commercial entertainment. The Service is licensed, not sold.
All software, artwork, audiovisual elements, names, logos, designs, text, gameplay presentation, and other content in the Service are owned by RENOVAR or its licensors and are protected by intellectual-property laws. You may not copy, modify, reverse engineer, decompile, distribute, sell, lease, sublicense, scrape, frame, or create derivative works from the Service except where applicable law gives you a non-waivable right to do so.
7. Virtual Items and In-App Content
The Service may include virtual coins, rewards, unlocks, rooms, cosmetic items, or other digital content ("Virtual Items"). Virtual Items are a limited license for in-app entertainment only and are not your property.
- We may add, remove, adjust, reset, or rebalance Virtual Items, rewards, and progression features to operate or improve the Service.
- You may not sell, trade, transfer, broker, lend, sublicense, or otherwise commercialize Virtual Items.
- Unauthorized secondary markets, exchanges, transfers, or redemption attempts are prohibited.
- If paid in-app purchases are offered, they must be made through the App Store or another approved platform billing method, and refunds are handled by the platform and applicable law.
8. Acceptable Use
You agree to use the Service lawfully and respectfully. You may not:
- Use bots, macros, scripts, emulators, modified clients, unauthorized tools, or automated methods to manipulate gameplay or Virtual Items.
- Exploit bugs, vulnerabilities, undocumented behavior, or design errors.
- Attempt to access, tamper with, overload, disrupt, or compromise the Service, our website, or related systems.
- Upload, transmit, or distribute malware, harmful code, spam, or abusive content through any support or communication channel.
- Use the Service for commercial solicitation, advertising, unauthorized data collection, or any illegal activity.
- Misrepresent your identity, violate another person's rights, or interfere with another user's enjoyment of the Service.
We may investigate suspected violations and may suspend, restrict, or terminate access where reasonably necessary to protect users, the Service, or our rights.
9. Updates, Availability, and Changes
We may update, modify, suspend, or discontinue all or part of the Service, including features, Virtual Items, rewards, content, compatibility, and website availability. Some updates may be required for continued use. We are not responsible for loss of local data caused by device failure, user deletion, app uninstallation, platform backup settings, operating system changes, or circumstances outside our reasonable control.
10. Third-Party Platforms and Services
Your use of the Service may also be subject to Apple App Store rules, device settings, operating-system terms, backup services, payment terms if purchases are enabled, and third-party services you choose to use. We are not responsible for third-party platforms or services that we do not control.
11. Support Messages and Feedback
If you send us support messages, screenshots, ideas, suggestions, or feedback, you grant us permission to use that material to respond to you, improve the Service, fix issues, and operate our business without compensation to you, subject to our Privacy Policy and applicable law.
12. Termination
You may stop using the Service at any time by deleting your local account where available and uninstalling the app. We may suspend, restrict, or terminate your access to the Service if you violate these Terms, create risk or legal exposure, misuse the Service, or if we discontinue the Service. Upon termination, your license to use the Service ends, and you must stop using the Service.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, compatible with every device, or free from data loss. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
14. Limitation of Liability
To the fullest extent permitted by applicable law, RENOVAR and its directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, local progress, virtual items, goodwill, profits, or device functionality arising out of or related to the Service. To the fullest extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of the amount you paid us for the Service in the six months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless RENOVAR and its affiliates from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of the Service, violation of these Terms, violation of law, or infringement of another person's rights. This obligation applies only to the extent permitted by applicable law.
16. Changes to These Terms
We may update these Terms to reflect product, legal, or operational changes. The latest version will be posted at https://opalorbitslots.com/terms.html with an updated effective date. If changes are material, we will provide notice as required by applicable law or platform rules. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of Colombia, excluding conflict-of-law rules, unless mandatory consumer protection laws in your location require otherwise. Before filing a formal claim, you agree to first contact us at [email protected] so we can try to resolve the issue informally. If a dispute cannot be resolved informally, it will be handled by competent courts, subject to any non-waivable rights you have under applicable law.
18. Severability and Entire Agreement
If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. These Terms, together with the Privacy Policy and any platform terms that apply to you, are the entire agreement between you and us regarding the Service.
